Terms of Use

These Terms of Use ("Terms") govern the use of our games ("the Game") provided by F4ntomGames Damian Kupper ("we," "us," "our"). By installing, accessing, or using the Game, you agree to these Terms.

Our games may use third-party services for authentication, data storage, analytics, and advertising, so make sure to read their terms as well:

1. Eligibility

You may use the Game only if you have the legal capacity to enter into a binding agreement under applicable law. The Game is not intended for children under 13. Users under 16, or under the age of legal capacity in their country, may use the Game only with permission from a parent or guardian.

The Game uses third-party authentication systems, including:

By using these systems, you agree to their respective terms and privacy policies. You are responsible for maintaining access to your authentication account.

3. In-Game Nickname

You may choose an in-game nickname, which is visible to other players. Offensive, misleading, or illegal nicknames, and nicknames that impersonate others, are prohibited. We reserve the right to remove or modify nicknames that violate these Terms.

4. User-Generated Content

The Game allows creation and uploading of user-generated content ("UGC"), including custom maps.

You retain ownership of your UGC. By submitting UGC, you confirm that you have the right to do so and grant us a non-exclusive, worldwide, royalty-free license to store, display, distribute, and use the content within the Game for as long as it remains available in the Game.

You may not upload UGC that:

  • violates law,
  • infringes intellectual property rights,
  • contains offensive, hateful, or harmful material,
  • was created outside the Game's UGC tools.

We may remove UGC at our discretion, in particular when it violates these Terms. To report unlawful or infringing content, contact us at support@f4ntomgames.dev; we will review the report and act on it without undue delay.

5. Local Content

The Game lets you add your own local content (such as music or maps). We have no influence on this content and are not responsible for it. You are solely responsible for ensuring that you hold all rights required to use it.

6. In-App Purchases (IAP)

The Game may offer optional in-app purchases. All transactions are handled by the platform provider (e.g., Google Play). We do not process or store payment information.

Refunds are subject to the refund policies of the platform provider. If you are a consumer in the European Union, please note that for digital content delivered immediately, your statutory right of withdrawal may be lost once delivery begins, following your prior express consent and acknowledgment given at purchase. Nothing in these Terms affects your statutory consumer rights, including rights relating to the conformity of digital content.

7. Data Storage

Account data, nicknames, and user-generated maps are stored in Unity Cloud services. Additional data may be processed by third-party providers as described in the Privacy Policy.

8. Account Deletion

You may delete your account through the in-game account deletion option. Deleting an account will permanently remove access to stored maps, nickname, and related data.

If you use Unity Authentication, you can also delete your Unity account here: player-account.unity.com/delete-account. You may also submit a deletion request at support@f4ntomgames.dev.

9. Prohibited Conduct

You agree not to:

  • interfere with or disrupt the Game or servers,
  • attempt to access accounts or data of other users,
  • reverse engineer, modify, or decompile the Game, except to the extent permitted by mandatory law,
  • exploit bugs, vulnerabilities, or unintended mechanics.

Any attempt to do so may result in suspension or termination of your access to the Game.

10. Intellectual Property

All rights to the Game, including code, assets, design, and branding, belong to us or our licensors, excluding UGC and local content. You receive a limited, non-exclusive, non-transferable license to use the Game for personal entertainment.

11. Termination

We may suspend or terminate your access to the Game if you violate these Terms or engage in fraudulent or harmful activities. Where reasonably possible, we will inform you of the reason. You may stop using the Game and delete your account at any time.

12. Disclaimer

To the extent permitted by law, the Game is provided "as is" without warranties of any kind, and we are not responsible for loss of data or service interruptions. This does not limit any warranties or rights that cannot be excluded under mandatory consumer protection law.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Game. Nothing in these Terms excludes or limits liability for intent, gross negligence, personal injury, or any other liability that cannot be excluded under applicable law.

14. Governing Law and Disputes

These Terms are governed by Polish law. If you are a consumer, this choice does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts competent under applicable law.

15. Changes to Terms

We may update these Terms from time to time. The current version is always published on this page together with its "last updated" date. We will notify you of material changes through the Game or our website before they take effect. If you do not agree with the updated Terms, you should stop using the Game and may delete your account; continued use after the changes take effect constitutes acceptance of the revised Terms.
